He had his door open. He doesn't need to give permission for the police to come in, he already did by opening the door. Will stand up in court, same thing with your glovebox in a car, if it is locked you need a warrant to open it. If it is unlocked, well, tough shit.
Thats my understanding of Canadian law, I'm sure american law is somewhat similar.
